CIDH CONDENA MUERTE DE ORLANDO ZAPATA EN CUBA

La Comisión Interamericana de Derechos Humanos (CIDH) lamenta profundamente y condena la muerte del disidente cubano Orlando Zapata Tamayo, quien murió de inanición tras 85 días de huelga de hambre. La CIDH expresa su pésame y solidaridad con sus familiares.

El señor Zapata Tamayo era una de las víctimas del Caso Número 12.476, donde la Comisión Interamericana recomendó al Estado de Cuba ordenar la liberación inmediata e incondicional de todas las víctimas declarando nulas las condenas en su contra, por haberse basado en leyes que imponen restricciones ilegítimas a sus derechos humanos. El informe de fondo de este caso, aprobado el 21 de octubre de 2006, también recomendaba adoptar las medidas necesarias para adecuar sus leyes, procedimientos y prácticas a las normas internacionales sobre derechos humanos, reparar a las víctimas y sus familiares por el daño material e inmaterial sufrido en virtud de las violaciones a la Declaración Americana establecidas en el informe, y adoptar las medidas necesarias para evitar que hechos similares volvieran a cometerse. El Estado de Cuba no ha cumplido con las recomendaciones de la CIDH.

Orlando Zapata Tamayo había sido detenido en marzo de 2003, en el contexto de una ola represiva del Estado de Cuba en contra de activistas de derechos humanos y periodistas independientes. Las más de 70 personas detenidas ese mes fueron sometidas entre el 3 y el 7 de abril de 2003 a procesos que no duraron más de un día, realizados a puertas cerradas, impidiendo la entrada reporteros, diplomáticos y público en general, al cabo de los cuales fueron sentenciados a cumplir penas de prisión de hasta 28 años. En esa ocasión, el señor Zapata Tamayo había sido condenado a tres años de prisión.

Posteriormente, el señor Zapata Tamayo fue condenado en Cuba a otras penas de cárcel, en virtud de sus opiniones disidentes. Según información periodística, habría sido sentenciado a 36 años de prisión. Información recibida por la CIDH indica que el señor Zapata Tamayo habría sido sometido a tortura y tratos inhumanos en la prisión Kilo 8.

Por otra parte, la CIDH recibió información de que tras la muerte del señor Zapata Tamayo, al menos 50 opositores habrían sido detenidos o forzados a quedarse en sus casas para evitar que fueran al velatorio y el entierro.

La Comisión vuelve a manifestar que las restricciones a los derechos políticos, a la libertad de expresión y de difusión del pensamiento, la falta de elecciones y la falta de independencia del poder judicial, configuran una situación permanente de trasgresión en Cuba de los derechos fundamentales de sus ciudadanas y ciudadanos. La Comisión insta una vez más al Estado a realizar las reformas necesarias conforme a sus obligaciones internacionales en materia de derechos humanos.

La CIDH desea reiterar en esta oportunidad al Estado de Cuba la recomendación de ordenar la liberación inmediata e incondicional de todas las víctimas del Caso 12.476, declarando nulas las condenas en su contra por haberse basado en leyes que imponen restricciones ilegítimas a sus derechos humanos. La CIDH insta además al Estado de Cuba a adecuar sus normas procesales a los estándares internacionales aplicables en materia de debido proceso, a fin de que las personas que acudan a los tribunales para la determinación de sus derechos y responsabilidades cuenten con garantías legales mínimas para ejercer sus medios de defensa.

La CIDH es un órgano principal y autónomo de la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión está integrada por siete miembros independientes que se desempeñan en forma personal, que no representan a ningún país en particular y que son elegidos por la Asamblea General de la OEA.



IACHR CONDEMNS DEATH OF ORLANDO ZAPATA IN CUBA

Washington, D.C., February 26, 2010 — The Inter-American Commission on Human Rights (IACHR) deeply regrets and condemns the death of Cuban dissident Orlando Zapata Tamayo, who died of starvation after 85 days on a hunger strike. The IACHR expresses its condolences and solidarity with his next of kin.

Mr. Zapata Tamayo was one of the victims in IACHR Case No. 12.476, in which the Inter-American Commission recommended to the State of Cuba that it order the immediate and unconditional release of all the victims in the case and overturn their convictions, inasmuch as they were based on laws that impose unlawful restrictions on their human rights. The report on the merits in this case, approved on October 21, 2006, also recommended that the State adopt the measures necessary to adapt its laws, procedures, and practices to international human rights laws; redress the victims and their next of kin for the pecuniary and non-pecuniary damages suffered as a result of the violations of the American Declaration established in the report; and adopt the measures necessary to prevent a recurrence of similar acts. The State of Cuba has not complied with the IACHR's recommendations.

Orlando Zapata Tamayo was detained in March 2003, as part of a crackdown by the State of Cuba against human rights activists and independent journalists. Between April 3 and 7, 2003, the more than 70 individuals who had been detained in March were subject to proceedings that lasted no longer than a day and were held behind closed doors, with access barred to reporters, diplomats, and the general public. At the end of the proceedings, they were sentenced to prison terms of up to 28 years. At that time, Mr. Zapata Tamayo was sentenced to three years in prison.

Subsequently, Mr. Zapata Tamayo was sentenced in Cuba to additional prison terms, due to his dissident opinions. According to news accounts, he had reportedly been sentenced to 36 years in prison. Information received by the IACHR indicates that Mr. Zapata Tamayo had been subjected to torture and inhumane treatment in the Kilo 8 prison.

Meanwhile, the IACHR also received information that, following the death of Mr. Zapata Tamayo, at least 50 dissidents reportedly were detained or forced to remain in their houses to prevent them from attending the wake and funeral.

The Commission reiterates that restrictions to political rights and to freedom of expression and the dissemination of thought; the lack of elections; and the lack of independence of the judiciary create a permanent situation in Cuba in which the fundamental rights of its citizens are violated. The Commission once again urges the State to carry out the reforms that are necessary in accordance with its international human rights obligations.

The IACHR would like to reiterate to the State of Cuba the recommendation that it order the immediate and unconditional release of all the victims in Case 12.476 and overturn their convictions, inasmuch as they were based on laws that impose unlawful restrictions on their human rights. The IACHR also urges the State of Cuba to adapt its legal procedures to applicable international standards for due process, so that those who go before the courts for a determination of their rights and responsibilities can count on the minimum legal guarantees to be able to exercise their defense.



A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Commission is composed of seven independent members who act in a personal capacity, without representing a particular country, and who are elected by the OAS General Assembly.
